About selling in Wyoming
In Wyoming, the sworn statement of what you sold for is not a public record. Every deed is accompanied by a statement of consideration, and state law says it must be kept confidential by the county clerk, assessor and state boards. Other parts of the Wyoming picture are just as particular: the mineral estate under a lot may belong to someone else, lenders can foreclose by advertisement with the sheriff selling at the courthouse door, and homeowners get a period to redeem after the sale. Whether you own a house in a small town, a ranch house on acreage or a home inherited from a relative, Swifty Home Buyers can make a cash offer on it as it stands, with no agent commissions and no repair list, and close on the date you choose. Here is how the Wyoming pieces fit together.

What it costs to sell in Wyoming
We did not find a state real estate transfer tax in Wyoming. Title 39 of the statutes, Taxation and Revenue, lists chapters on ad valorem, sales, use, fuel and other taxes and no chapter on a transfer tax, but ask your title company to confirm the recording charges for your county. What Wyoming does have is a sworn statement of consideration. Under W.S. 34-1-142, a deed or other instrument transferring title to real property is accompanied by a statement under oath by the grantee or the grantee's agent that discloses the names and contact information of the grantor and grantee, the date of transfer and of sale, a legal description, the actual full amount paid or to be paid, the terms of sale and an estimate of the value of any nonreal property included in the sale. The statute states that the statement is not a public record and shall be held confidential by the county clerk, county assessor, county board of equalization, the state board of equalization and the department of revenue. Your real costs sit elsewhere: agent commissions in a traditional listing, payoff of your mortgage and liens, prorated property taxes and attorney or title fees. When you sell to Swifty there is no commission, and we show you the closing costs in writing before you sign anything.
Rules to know when selling in Wyoming

If you're behind on the mortgage
Wyoming allows foreclosure by advertisement under a power of sale in the mortgage, without a lawsuit first. W.S. 34-4-102 allows it within ten years after the mortgage or the debt matures or after recording, and 34-4-103 requires, among other things, that written notice of intent to foreclose be sent to the record owner, and the person in possession if different, by certified mail at least ten days before publication of the notice of sale begins. Under 34-4-104, the notice of sale is published for four consecutive weeks, at least once each week, in a newspaper in the county, and certified mail goes to the owner, the occupant and subordinate lienholders at least 25 days before the sale. Under 34-4-106 the sale is a public sale between 10 a.m. and 5 p.m. at the front door of the courthouse or the place the district court sits, run by the person named in the mortgage or by the sheriff or a deputy, to the highest bidder, and a sale that does not follow those rules is void. After the sale, W.S. 1-18-103 gives a right of redemption: three months from the date of sale after a sale under execution, a decree of foreclosure or foreclosure by advertisement, or twelve months where the mortgage covers agricultural real estate, which the statute defines as a single parcel over 80 acres outside a city, town or recorded subdivision, or farm property that adds up to 80 acres or more. To redeem you pay the purchase price or the bid, plus interest at ten percent a year from the date of sale, plus certain taxes, assessments and prior liens the purchaser paid. W.S. 34-4-113 requires the mortgagee to account for any surplus on demand and states that the mortgagor is liable for any deficiency. Wyoming Housing Network describes its foreclosure counseling as a HUD-certified resource offered at no cost. If you sell before the sale, the payoff comes out of the proceeds and the equity is yours instead of being decided by an auction bid.
Other situations we help with
- Ranch houses and homes on acreage: tell us what is on the land, and whether any minerals were reserved, and we will say upfront whether we can make an offer.
- Houses with a foreclosure notice in the mail: a sale that closes before the advertised courthouse sale can pay off the lender and leave you the equity.
- Properties where mineral or surface rights were split years ago: we buy as-is and work with your title company on what is being conveyed.
- Inherited homes and houses where the owner has died: we coordinate with your attorney so every needed signature is in place.
- Older houses in small towns with deferred maintenance, a failing roof or an aging septic system: we do not ask you to fix anything first.

Area notes
Sweetwater County and Green River
The Sweetwater County Assessor's office at 80 W. Flaming Gorge Way in Green River explains how the statement of consideration works in practice. It says the statement is to be completed whenever a deed, contract or other document transferring legal title is recorded, that the information on it is not public information and is protected under W.S. 34-1-142(e), and that disclosure is restricted except during assessment appeals. For a seller, that means the price is reported on a confidential statement rather than a public record; ask your title company whether anything about price will appear on the recorded deed itself.
