About selling in Newark

Newark's city code reaches a long way into a home sale. It has its own certificate for transfers, a separate inspection when rental units turn over, a registry for vacant and foreclosing properties, and review rules in historic districts. Swifty Home Buyers makes firm cash offers on Newark houses: no financing contingency, no agent commissions, no repair requests, and you choose the closing date. Below are specifics from Newark's own code and city web pages. Fees and procedures change, so confirm them with the city or a local attorney. This is general information, not legal advice.

Areas we cover: North Ward, South Ward, East Ward, West Ward, Central Ward, Ironbound, Vailsburg, Weequahic, Forest Hill, Roseville, Clinton Hill, Lincoln Park, Downtown, Mount Pleasant, Fairmount, University Heights

What the sale certificate costs and what it covers

Under Chapter 41:18 of the city code, a person who plans to sell or convey a dwelling must apply to the Director of the Department of Engineering for a certification that the property conforms to the housing and zoning ordinances. The code sets a fee by building size: $400 for one or two units, $500 for three to ten, $1,000 for eleven to twenty, $2,000 for twenty-one to forty, and $5,000 for forty-one to one hundred. The code also says transferring title before the certificate issues is a violation, with a fine of $500 to $2,000, up to 90 days in jail, or both.

A second inspection when rental units change hands

Chapter 18:6 is separate from the sale rule. Before any change in occupancy of a dwelling or apartment unit, it says a Certificate of Code Compliance must be obtained from the Department of Engineering. The code lists a $100 rental unit inspection fee that includes one re-inspection, with $75 for each extra one, and says the inspection must happen within 10 days of the application or a temporary certificate for 30 days results. A certificate is valid for 90 days, during which a tenant must move in, new construction is exempt for five years after its final certificate of occupancy, and violations carry fines of $100 to $1,000.

Who is exempt from Newark rent control

Chapter 19:2 lists what falls outside rent control: public housing, transient hotel and motel stays, commercial buildings, newly constructed dwellings for up to 30 years or the mortgage amortization period (whichever is shorter), substantially rehabilitated vacant properties for five years, and owner-occupied buildings of four units or fewer where the owner lives in one unit. Registration is annual, and the code says an unrented unit cannot be rented until it is registered and a certificate of habitability is issued. Rent increases need 30 days' written notice, and the Rent Control Board can impose a penalty of up to $500 per violation.

The vacant and foreclosure property registry

Tax collector, tax sales and water accounts

The code makes the head of the Division of Revenue Collections the City Tax Collector and charges that office with certifying searches for tax and other liens on real property and collecting water revenue. The city says tax bills are due February 1, May 1, August 1 and November 1, that partial payments go to the oldest balance first, and that late interest is 8% on the first $1,500 and 18% above that. Its finance page describes standard tax sales for prior-year balances and accelerated sales when current taxes are unpaid after November 10; either way a tax lien certificate is sold and filed against the property. The city lists 973-733-3791 for tax questions and 973-733-6371 for water and sewer.

Historic districts and city help for owners

Newark's code maps twenty historic districts, including Forest Hill, Lincoln Park, Roseville, Vailsburg, Weequahic and the Ironbound. In a designated district, the code says no building permit is issued and no work starts before Historic Preservation Commission review, and demolition needs five favorable votes. Separately, the city's Live Newark program offers owner-occupants facade improvement loans of up to $40,000 at 0% interest, forgiven at 20% per full year of continued occupancy over five years, so ask the city how an unforgiven balance is handled before selling. For owner-occupants facing foreclosure, the state's Foreclosure Mediation Assistance Program requires a mediation request within 60 days after service of the summons and complaint.

Common situations

  • You own a Newark two- or three-family and the certificate fee, the inspection and a possible 20-day violation list feel like too much to take on before closing.
  • Your Newark rental keeps turning over and each new tenant triggers another inspection and certificate.
  • You inherited a vacant Newark house and are unsure whether it must be on the city's vacant property registry.
  • You are a landlord with a building near the owner-occupied, four-units-or-fewer line and would rather not untangle your rent control status before selling.
  • Your Newark house sits in a historic district and you would rather sell as-is than plan repairs that need commission review.
